On behalf of all of us at Health Law Advocates and those we serve, I extend our sincere thanks for the wonderful support given by so many good friends and generous sponsors to our recent 16th Annual Benefit Breakfast.

 

The support derived from the Breakfast (which exceeded our goal!) will make it possible for us to continue to advocate for health care justice for the most vulnerable members of our society.  Our free legal services for low-income individuals and families who are improperly denied access to life-sustaining health care or burdened with unaffordable medical bills here in Massachusetts are only possible because of you.

 

The Breakfast was a wonderful event and the turnout surpassed even our high expectations.  Congressman Patrick Kennedy's passionate keynote speech underscored why HLA's services are so critical at this time. Despite legislative victories to improve access to health care, many low-income Massachusetts residents still have great difficulty accessing and paying for the health care they need.  

 

We are very grateful to Patrick Kennedy for supporting HLA and we look forward to continued collaborations with him as he builds his impressive One Mind for Research initiative. We also owe special thanks to our stellar Breakfast co-chairs Brent Henry and Dean Richlin for their tireless efforts over the past six months to make the event a success.

16th Annual Benefit Breakfast

Nearly 900 of HLA's friends and their guests gathered in the Grand Ballroom at the Sheraton Boston on Wednesday, November 9 to enjoy HLA's 16th Annual Benefit Breakfast. HLA's "Sweet Sixteen" celebration was one to remember as our guests arrived early for networking followed by a program that featured the wonderful musical talents of Sheena Melawi, a powerful film on HLA's work by Tira Khan, a moving message from HLA client Susan Breen about how HLA helped her obtain insurance coverage for treatment for a recurring brain tumor, and a dynamic keynote address by Patrick Kennedy.

Kennedy, a former congressman from Rhode Island and son of the late Senator Edward Kennedy, believes it is time for the nation to move beyond the dark ages regarding mental illness. Nearly 100-million Americans are living with a neurological disorder and it is time, Kennedy declared, to recognize the brain is an organ and the diseases of that organ should not carry stigma. Kennedy used his own struggle with addiction and depression as a platform to launch his One Mind for Research initiative -- a ten-year campaign that Kennedy referred to as "our moonshot to inner space." His One Mind for Research foundation hopes to raise $5-billion to unify research into the anatomy of brain disorders.

 

Before leaving Congress in January 2010, Kennedy authored the Mental Health Parity and Addiction Equity Act of 2008 which requires health insurers to provide non-discriminatory coverage for mental health and addiction treatment.

Client Profile: Ahmed Zouhir 

 

Ahmed Zouhir 1Ahmed Al Mokhtar Zouhir was born with only one ear -- his left, that was essentially closed and missing its lobe -- as well as serious dental problems that caused him continual pain. The 21-year-old who was born in Rabat, Morocco could not hear very well out of the disfigured ear. His condition was obvious to others and he grew up enduring cruel jokes. As a child, he asked his mother to buy him ear muffs to hide his condition. 

 

When Ahmed was 12, he and his family were planning to immigrate to the United States. His mother had already learned about a special surgical center in the U.S. which transforms the lives of children in financial need who are born with facial deformities through corrective procedures. The center had agreed to perform the necessary surgeries to help Ahmed once he was living in the U.S.  Ahmed applied for a visa in 2001 to come to the USA, but the terrible events of September 11 prevented him from doing so. It would not be until he was 18 that Ahmed would be able to immigrate to the U.S.

 

"I was no longer a child, but the (surgical center) stood by their commitment to me," Ahmed recalls. Ahmed had received his Green Card and had started his new life in the metro Boston area. He was prepared to enroll in a public insurance program for low-income Massachusetts residents and everything seemed to be in place for an end to his nearly two decades of physical and emotional distress. But Ahmed's plans received a serious setback when the Massachusetts Legislature eliminated eligibility in the public insurance program for low-income legal immigrants who were not yet U.S. citizens. The young man's lifelong dream seemed crushed. Ahmed turned to HLA for help.  With Lorianne Sainsbury-Wong, HLA's Litigation Director, representing him, Ahmed filed an appeal requesting a waiver to permit him to enroll in the insurance plan. The appeal was granted and Ahmed was able to have the surgeries he needed to change his life. "Ahmed's medical situation was unique," said Attorney Sainsbury-Wong. "In seeking a waiver to get him the surgery he needed, I was able to work with Ahmed's doctors and with the insurance company for a successful resolution on his behalf."

 

"I know that the brighter future I now have could only have been possible in the United States of America," Ahmed wrote in his thank you message to HLA. His surgeries are done and he now has a normal-looking ear. The physical pain Ahmed lived with every day because of his bad teeth, and the emotional pain caused by his deformed ear and impaired hearing are behind him. Ahmed said he is now looking forward to the day three years hence when "I can call myself a citizen of this great country."

Board Profile: Mala Rafik


In January, Mala M. Rafik will assume the duties of President of HLA's Board of Directors, succeeding current president Dan Jackson. Mala is a partner at Rosenfeld Rafik & Sullivan, P.C., a Boston-based law firm representing clients throughout New England who have been denied short- and long-term disability benefits by private insurance carriers.  The firm also concentrates on obtaining health, life, long-term care and Social Security disability insurance benefits for its clients. 

 

Mala RafikMala's clients are typically individuals with debilitating chronic illnesses and disabilities for whom she has achieved several pivotal litigation victories in state and federal court.  She is the Chair of the Health and Disability Law General Committee within the Tort Trial & Insurance Practice Section of the American Bar Association, the Chair-Elect of the Insurance Law Section of the American Association for Justice, a former member of the Boston Bar Association Council, a member of the Mentoring and Legal Referral Services Committees of the Boston Bar Association, and a member of the Massachusetts Bar Association General Practice, Solo, and Small Firm Section Council. 

 

She also serves on the boards of  Massachusetts Advocates for Children and Massachusetts Correctional Legal Services.  Mala, a graduate of Colby College and Northeastern University's School of Law, also teaches Disability Law at the New England School of Law. Mala and Rosenfeld Rafik & Sullivan, P.C. were nominated for a 2011 Massachusetts Bar Association Pro Bono Award.
